By accessing this website, purchasing products from Overbuilt, or using any products sold by Overbuilt, you acknowledge that you have read, understood, and agreed to the following terms.

Off-Road / Closed-Course Use Only

Unless expressly stated otherwise, all products sold by Overbuilt are designed, marketed, and intended for closed-course competition, private property, or off-road use only.

Overbuilt does not encourage, endorse, or promote the use of its products on public streets, highways, sidewalks, bicycle paths, or any location where such use would violate local, state, federal, or international laws or regulations.

It is solely the customer's responsibility to understand and comply with all applicable laws regarding the installation and use of any product purchased from Overbuilt.

Customer Responsibility

The customer is solely responsible for:

  • Determining whether a product is compatible with their vehicle.

  • Proper installation of all products.

  • Inspecting products before every use.

  • Performing routine maintenance.

  • Using products in a safe and responsible manner.

  • Wearing appropriate protective equipment.

  • Operating their vehicle within their skill level.

  • Following all applicable laws and regulations.

Improper installation, modification, misuse, abuse, neglect, lack of maintenance, racing, jumping, stunt riding, collisions, crashes, or operation beyond a product's intended purpose may result in equipment failure, property damage, serious injury, or death.

Assumption of Risk

Motorsports, off-road riding, racing, stunt riding, and similar activities involve inherent risks that cannot be eliminated.

By purchasing or using any Overbuilt product, you voluntarily assume all risks associated with installation, operation, maintenance, transportation, storage, and use of the product.

These risks include, but are not limited to:

  • Loss of vehicle control

  • Mechanical failure

  • Product failure caused by misuse or impact

  • Collision

  • Serious bodily injury

  • Permanent disability

  • Death

  • Property damage

Professional Demonstrations

Photos, videos, advertisements, social media content, promotional materials, and demonstrations produced by Overbuilt may depict experienced riders, controlled environments, modified vehicles, professional photography techniques, or closed-course riding.

Any stunts, wheelies, jumps, drifting, racing, or other high-risk maneuvers shown are performed under controlled conditions by experienced individuals.

These activities are not intended as instructions or encouragement for customers to imitate.

Do not attempt to recreate any maneuver shown in Overbuilt content.

No Guarantee of Safety

No aftermarket part can eliminate the risks associated with operating a vehicle.

Installation of an Overbuilt product does not make a vehicle safer, crash-proof, or immune from failure.

Customers should always inspect their vehicle before riding and discontinue use immediately if any damage, looseness, unusual wear, or malfunction is observed.

Product Compatibility

Compatibility information is provided to the best of our knowledge.

Customers are responsible for confirming compatibility before placing an order.

Vehicle modifications, aftermarket components, manufacturer revisions, and production changes may affect fitment.

Overbuilt is not responsible for damage resulting from incompatible installations or improper fitment.

Installation Disclaimer

Many products require mechanical knowledge and proper tools for safe installation.

If you are not qualified to install a product safely, installation should be performed by a qualified technician.

Overbuilt is not responsible for damage or injury resulting from improper installation or modification.

Modification Disclaimer

Many products sold by Overbuilt modify the original design or performance characteristics of a vehicle.

Customers understand that modifying a vehicle may:

  • Affect handling

  • Affect braking performance

  • Increase wear on other components

  • Void manufacturer warranties

  • Make the vehicle unsuitable or unlawful for public-road use in some jurisdictions

The customer accepts full responsibility for any consequences resulting from vehicle modifications.

Limitation of Liability

To the maximum extent permitted by applicable law, Overbuilt shall not be liable for any indirect, incidental, special, exemplary, punitive, or consequential damages arising out of or related to the purchase, installation, or use of its products.

This includes, but is not limited to:

  • Personal injury

  • Death

  • Property damage

  • Vehicle damage

  • Lost income

  • Lost profits

  • Loss of business

  • Loss of use

  • Towing expenses

  • Repair costs

  • Rental vehicle expenses

  • Travel expenses

  • Labor charges

  • Attorney's fees

  • Any other economic or non-economic losses

Where applicable law does not permit certain limitations, this section applies to the fullest extent allowed by law.

Customer Responsibility for Safe Operation

Customers are solely responsible for operating their vehicles safely and lawfully.

Overbuilt assumes no responsibility for injuries, damages, citations, arrests, criminal charges, civil liability, or other consequences arising from:

  • Reckless riding

  • Speeding

  • Street racing

  • Stunt riding

  • Wheelies

  • Riding on public roads where prohibited

  • Illegal operation of a vehicle

  • Failure to wear appropriate safety equipment

  • Operation while impaired

  • Any violation of applicable law

Inspection and Maintenance

Products should be inspected regularly.

Fasteners should be checked for proper torque.

Any product showing signs of cracking, excessive wear, bending, corrosion, impact damage, or other defects should be removed from service immediately.

Failure to inspect and maintain products may result in equipment failure.

Warranty Limitations

Any applicable warranty covers defects in materials or workmanship only.

Warranty coverage does not apply to products that have been:

  • Improperly installed

  • Modified

  • Misused

  • Crashed

  • Abused

  • Neglected

  • Used contrary to product instructions

  • Used beyond their intended purpose

  • Subjected to normal wear and tear

Governing Law

These terms shall be governed by and interpreted in accordance with the laws applicable to Overbuilt's principal place of business, without regard to conflict-of-law principles, except where mandatory consumer protection laws require otherwise.

Severability

If any provision of this Legal Notice is determined to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

Acceptance

By purchasing, installing, or using any product sold by Overbuilt, you acknowledge that you have read, understood, and agreed to this Legal Notice and assume all risks associated with the use of aftermarket performance products.
